Dear users,
Thank you for choosing the Crestvault COIN service. Crestvault COIN Service Agreement (hereinafter referred to as "This Agreement") is provided by Crestvault COIN PTE. LTD. (hereinafter referred to as "the Platform", registration number: 202100968N, this platform is registered simultaneously in Singapore and Sweden, Registered address: 9 Temasek Boulevard #04-02 Suntec Tower Two Singapore 038989 176 22 Stockholms LAN, Sweden.) and you (the "User"), and this Agreement has the legal effect of the contract between you and the Platform. In this agreement :(1) "we" and "we" refer to the platform, and "our" shall be construed accordingly; And (2) "you" refers to the User, and "yours" shall be construed accordingly. You and the Platform are individually referred to as a Party and collectively as the Parties.
The platform hereby reminds you that before using our Crestvault COIN mobile App (hereinafter referred to as "Crestvault COIN" or the "Software", Crestvault COIN can be downloaded on various mobile application platforms, including but not limited to Google Play and Apple App Store), Please carefully read this Agreement and the relevant agreements referred to below to ensure that you fully understand the terms of this Agreement.
I. Confirmation and acceptance of this Agreement
1. You understand that this Agreement and related agreements apply to Crestvault COIN and the decentralized applications (" DApps ") independently developed and owned by Crestvault COIN platform (excluding dApps developed by third parties).
2. By downloading The Crestvault COIN software and creating an identity, you are deemed to have fully read and accepted all terms of this Agreement, which is effective immediately and binding on both parties.
3. When accessing or using Crestvault COIN, you agree to:
(1) Be bound by the latest version of this Agreement (without change or modification);
(2) You are of legal age to use Crestvault COIN in your jurisdiction,
(3) You are not a excluded person (as defined in this Agreement).
4. This Agreement can be updated by the Platform at any time, and once the modified agreement is published on Crestvault COIN, it will automatically take effect without further notice (it will not be updated frequently).
II. the definition
1. China: refers to the People's Republic of China, including Hong Kong Special Administrative Region, Macao Special Administrative Region and Taiwan Region.
2.Crestvault COIN: refers to the digital wallet developed by the platform based on blockchain, including other auxiliary tools developed for the convenience of users to use blockchain system.
3. Excluded Persons:
(1) persons other than natural persons who have the legal and conscious capacity to enter into this Agreement;
(2) Users who are prohibited, restricted, unauthorized or ineligible to use the Services (as defined in this Agreement) in any form or form (in whole or in part) due to this Agreement, legal, regulatory requirements or regulations of the jurisdiction applicable to such user. For the avoidance of doubt, users in China are also included in the definition of "excluded persons".
4. Identity: Refers to the numeric identity generated based on your public and private key pair.
5. Beginner's Guide: Refers to the Crestvault COIN operation guide provided by this platform to help you understand the basics of blockchain before you use Crestvault COIN (and in the future).
6. Wallet Creation: Means the process of creating a wallet using Crestvault COIN after you accept this Agreement.
7. Wallet Password: means the password you determine during the creation of the Crestvault COIN Wallet, which will be used to encrypt and protect your private key. Crestvault COIN is a decentralized application. The wallet password is not stored on your mobile device or the platform's server. If you lose or forget your wallet password, you need to reset your wallet password with a private key or mnemonic or email.
8. Message prompt: The message prompt content involved in the Operation interface of Crestvault COIN software is recommended for users to follow the relevant steps.
9. Specific Users: refer to users who are required to cooperate with the Platform in fulfilling their personal information disclosure obligations in accordance with laws, regulations and policies of Singapore and other countries.
10. Developer Users: users who use Crestvault COIN open source code, Developer Mode and other services for developers in accordance with the platform notice and relevant open source agreements.
11. Private key: it is composed of certain characters randomly selected from the 56-bit random character pool and is the core of the digital token owned and used by users.
12. Public key: the private key is generated by one-way derivation with the help of cryptography principle, and used to generate block chain digital wallet address, digital wallet address is the public receipt address.
13. Mnemonics: Conforming to the blockchain BIP39 industry standard, consisting of 6 (or 12/15/18/21/24) ordered words generated by a random algorithm. Is an easy record of the private key form, convenient for users to backup custody.
14. Digital tokens: refers to the types of digital tokens currently supported by Crestvault COIN, including but not limited to BTC, ETH, Crestvault COIN, etc.
15. Materials: refer to articles and other materials in the built-in section of "Community" on Crestvault COIN. These materials are owned by the platform and shall not be reproduced without authorization. These information with authority review, can refer to your investment.
16. Messages and announcements: refers to the inbox where users can receive messages or notifications from the Platform.
17. Personal Information: Refers to electronic or other ways to record can be alone or combined with other information to identify the user identity of all kinds of information, including but not limited to natural person's name, date of birth, id number, personal biometric information, address, telephone number, bank card number, E-mail address, wallet, mobile devices, information, operation records, trading records, etc., But does not include the user's wallet password, private key, mnemonic,.
18. Smart Contract: refers to an Ethereum-based smart contract that aims to propagate, validate or enforce contracts in an informationized manner, including but not limited to Kyber and/or 0X as mentioned below. Crestvault COIN integrated smart contract does not provide cross-chain service at present. Cross-chain service is under development and the service will be announced in the form of announcement.
19.ETH: Refers to Ethereum, a cryptodigital token associated with the Ethereum blockchain, which does not include "Ethereum Classic" for the avoidance of doubt.
20.Crestvault COIN Open source code: refers to part of the Crestvault COIN software code that is publicly declared open source by the Platform, allowing developer users to use (including secondary development) such separate source code in accordance with the relevant open source agreement and the platform notice.
21. Open Source License: refers to the third-party open source license that developer users must follow when using the Crestvault COIN open source code.
22. Third-party Services: refer to products and services provided by third-party DApps, third-party smart contracts, third-party open source agreements, third-party hardware wallets, third-party web pages, third-party exchanges, etc.
III. Crestvault COIN Service (collectively, the "Service")
1. Create an identity. You can use the "Create Identity" button provided by Crestvault COIN to create an identity and manage multiple wallet chains simultaneously under one identity.
2. Transfer and collection. You can manage digital tokens using Crestvault COIN's transfer and receipt functions, which use private keys to sign electronically and modify the ledger of the relevant blockchain. A transfer is a transfer by the payer using the recipient's ENS domain name or blockchain address, and the "transfer" involves a valid record of the transaction in the distributed ledger of the relevant blockchain system (as opposed to the actual delivery or transfer of a digital token on Crestvault COIN).
3. Market check. You can use Crestvault COIN to view the exchange rates of digital tokens provided by third parties. Crestvault COIN captures the corresponding digital token exchange rate information and displays it in the "market" section of Crestvault COIN.
4.Flash trading (IEX). The exchange of digital tokens between users can take place and be completed on the third-party smart contract Kyber. Crestvault COIN is used as an interface tool to help users interact with the third-party smart contract and display the corresponding results of the exchange between users.
5. Browse dApps. Users access and use the services provided by the DApp (including the platform's own DApp and third-party DApp) through Crestvault COIN.
6. Transaction records. We will copy all or part of your transaction records through the blockchain system.
7. Others (services deemed necessary by the Platform).
When accepting the above services provided by the Platform, users understand and accept that:
1. Adhering to the decentralized characteristics of blockchain, and in order to protect the security of your digital token, the platform provides decentralized services, which are greatly different from banking financial institutions. Users understand and accept that the Platform does not assume the following responsibilities:
(1) Store the user's wallet password (that is, the password set when the user creates the wallet), private key, mnemonic;
(2) retrieve the user's wallet password, private key and mnemonic;
(3) Freeze your wallet;
(4) Reporting loss of wallet;
(5) Recover the wallet;
(6) Trading rollback.
2. You shall be responsible for keeping the mobile devices containing Crestvault Coins, backing up Crestvault Coins, and backing up wallet passwords, mnemonics and private keys.
3. The digital token management service provided by the platform and Crestvault COIN does not cover all existing digital tokens. Do not operate any digital tokens not supported by Crestvault COIN through Crestvault COIN.
4. Integrated DApps on Crestvault COIN include dapps owned by the platform and dApps provided by third-party platforms. For dApps provided by third party platforms, Crestvault COIN only provides search and blockchain browser functionality for users to access the DApp, without any guarantee of functionality or quality of service of the third party DApp. Users should judge and evaluate whether there are risks in the services or transactions provided by the third-party DApp before accepting services or conducting transactions on the third-party DApp.
5. The essence of the flash exchange function provided on Crestvault COIN is the exchange of digital tokens on the blockchain system by users using third-party smart contracts. For services provided by third-party smart contracts, Crestvault COIN can guarantee the security of users using third-party smart contracts and guarantee the functions or service quality of third-party smart contracts.
Iv. Your Rights and obligations
(1) Create a wallet
1. Create a wallet: You have the right to create a wallet on your mobile device through Crestvault COIN, set the wallet password and other information of the wallet, and have the right to use your wallet to transfer money, receive money, grid transactions, pledge mining and other transactions on the blockchain through Crestvault COIN app.
2. Authentication: In accordance with the requirements of relevant laws and regulations, when using the relevant services provided by Crestvault COIN, certain users shall complete the authentication in a timely manner as prompted by Crestvault COIN. We may require you to submit personal information including but not limited to your name, ID number, mobile phone number and other personal information.
3. The platform may develop different software versions for different terminal devices. You should download an appropriate version for installation according to actual needs. If you obtain the software or an installation program with the same name as the software from an unauthorized third party, the platform will not be able to guarantee the normal use of the software or its security, and you shall be liable for any loss caused thereby (please check the official download address).
4. After the new version of the software is released, the old version of the software may be unavailable. The platform does not guarantee the security, continued availability and corresponding customer service of the old software. Please check and download the latest version at any time.
(2) Use
1. You shall be responsible for properly keeping your mobile device, wallet password, private key, mnemonic and other information. The platform is not responsible for keeping the above information for users. You shall bear all risks, liabilities, losses and expenses caused by the loss of your mobile device or hardware wallet, active or passive disclosure or forgetting of wallet password, private key, mnemonic, etc.
2.Crestvault COIN message prompt. You understand and agree to follow the information tips posted by the Platform on Crestvault COIN and perform operations according to the information tips, otherwise, all risks, liabilities, losses and expenses caused thereby shall be borne by you.
3. You acknowledge and understand that Crestvault COIN has no obligation to perform due diligence with respect to third party services and that you should carefully evaluate and assume all risks associated with your use of Crestvault COIN.
4.Provide information and documentation. If the Platform in its sole discretion deems it necessary to obtain user information in order to comply with any applicable laws or regulations relating to the use or operation of Crestvault COIN, the User shall provide such information to the Platform in a timely manner as requested by the Platform. User commitment to this platform told anything about it on the basis of this agreement to any change in this platform to provide documents and information, and without notifying the written notice of any change of circumstances, this platform has the right to think that the contents of the documents and information provided by the user, is true and correct and no misleading information and no change.
5. Complete the authentication. When this platform reasonably think anomalies in your trading, or trading, or that there is doubt your identity information, or this platform that should check your id card or other necessary documents, please actively cooperate with the platform to check your valid id card or other necessary documents, timely complete the relevant authentication.
6. Transfer.
1.You acknowledge that the daily transfer limit and number of transactions you can use in the Crestvault COIN Service may vary depending on the country/region where you use the transfer service, regulatory requirements, transfer purposes, Crestvault COIN risk control, identity verification and other issues.
2.You understand the "irrevocable" attribute of blockchain-based operation. When you use the Crestvault COIN transfer function, you shall be liable for the consequences caused by your operation mistakes (including but not limited to the wrong transfer address or your choice of transfer node server).
3.You acknowledge that when using the Crestvault COIN service, the transfer function may be unavailable, the transfer "transaction failure" or the "package timeout" may occur under the following circumstances:
A) Insufficient wallet balance;
B) insufficient transaction miner fees;
C) failure of blockchain to execute smart contract code;
D)beyond the regulatory authorities
E) Network, equipment and other technical faults;
F) Block chain network congestion, failure and other reasons cause the transaction is abandoned;
G) Your address or the counterparty's address is identified as a special address, such as a high-risk address.
4.You understand that Crestvault COIN only provides you with a transfer tool. After you complete the transfer using Crestvault COIN, the Platform will complete all the obligations of the service, and the platform will not be liable for any other relevant disputes.
7. The flash. You are aware that the daily limit of flash cash is currently limited by a third party smart contract. The Platform may also limit and adjust the daily amount of flash exchange or coin exchange for users from time to time.
8. Legal compliance. You acknowledge that you should comply with relevant laws, regulations and national policies when operating Crestvault COIN or using DApp or smart contract on Crestvault COIN for transactions.
9. Announcements and notices. Crestvault COIN will send you notifications in the form of website announcements, emails, message center messages, pop-up prompts or client notifications, such as notifying you of transaction progress or prompting you to perform relevant operations. Please pay attention in time.
10.Service Fees and Tax liabilities:
10.1 When you use the Flash exchange service of Crestvault COIN, a third party smart contract will charge you a commission or service fee. The specific fee is subject to the amount charged by the third party smart contract. The information prompt of Crestvault COIN is for reference only.
10.2 The Platform will not charge you any service fee or handling fee in any form for the time being, and the Platform will separately agree or announce rules for charging for certain services in the future;
10.3 When you use Crestvault COIN to transfer money, you should pay "miner fee" or network fee, the amount is not fixed and will be charged by the relevant blockchain network;
10.4 You acknowledge that your transfer operation may fail under certain circumstances (including but not limited to insufficient "miner's fee" or network fee you paid for the transfer during the transfer period, or instability of the relevant blockchain network); In such cases, you will be charged a miner's fee by the relevant blockchain network even if your transfer operation is not completed;
10.5 You shall be responsible for all taxes and other expenses incurred by you in conducting transactions on Crestvault COIN.
(3) Developer users' development based on Crestvault COIN open source code
1. Developer users have the right to use the Crestvault COIN open source code published by the Platform in official channels for secondary development of the application, and download and use any patches or bug solutions issued by the Platform for Crestvault COIN open source code.
2. When using Crestvault COIN open source code, the Developer User understands and agrees that:
(1) Developers shall contact and inform the Platform in a timely manner if they find any vulnerabilities, defects or software improvement schemes during the use of Crestvault COIN open source code, and shall stop any harmful use behaviors (if applicable);
(2) The Crestvault COIN open source code may contain third-party open source agreements and source codes, and the platform does not provide any form of guarantee for the functions, virus-free and vulnerability free of such third-party open source agreements and source codes. Developer users should judge and evaluate the consequences of their use of Crestvault COIN open source code. Developer user should carefully read and follow the relevant open source software agreement (including but not limited to the Apache agreement http://www.apache.org/licenses/LICENSE-2.0.html) and the requirements of this international platform from time to time to make a notification.
V. Alteration, interruption and termination of services
1. You understand and agree that the Platform may, at its sole discretion, temporarily provide some service functions, or suspend some service functions or open new service functions in the future. When we change our services, as long as you still use Crestvault COIN, you still agree to this Agreement or the amended terms of this Agreement.
2. In order to avoid as much as possible any misoperation of Crestvault COIN or any security risks associated with digital tokens, you should avoid using Crestvault COIN without basic knowledge of blockchain. For users who do not have basic knowledge of blockchain, please operate under the guidance of your referees.
3. You understand that the Platform will suspend the provision of services (or completely terminate the services if any of the following circumstances occur) :
(1) The operation of Crestvault COIN is interrupted due to technical reasons such as equipment and blockchain system maintenance, upgrade, malfunction and communication interruption (we will inform you as soon as the repair is completed);
(2) there is a material adverse change in applicable laws or policies;
(3) Other circumstances beyond the control or reasonably foreseen by the Platform occur (basically none).
4. The Platform may unilaterally suspend or terminate the user's use of Crestvault COIN in part or in whole when:
(1) The user dies;
(2) stealing other people's wallet information or mobile devices;
(3) Fill in false personal information on Crestvault COIN;
(4) Reject the forced update operation of Crestvault COIN;
(5) Using Crestvault COIN open source code in violation of the third-party open source agreement or the provisions of the platform notice;
(6) Using Crestvault COIN for illegal or criminal activities;
(7) Impede the normal use of Crestvault COIN by other users;
(8) pretending to be the staff or management personnel of the Platform;
(9) Attack, invade, change or threaten the normal operation of the computer system of the Platform in any other way;
(10) Spam advertising using Crestvault COIN;
(11) Spreading rumors and damaging the goodwill of the Platform and Crestvault COIN;
(12) Illegal acts, other violations of this Agreement, and circumstances in which the Platform reasonably considers that functions should be suspended.
5. If the Platform changes, interrupts or terminates the service, you have the right to export your wallet and other information within a reasonable time.
VI. Your representations and warranties
1. You shall abide by the laws and regulations of the country or region where you live and shall not use Crestvault COIN for any illegal purpose or in any illegal way.
2. You are not an excluded person who is ineligible to use the Crestvault COIN service.
3. You shall not use Crestvault COIN to engage in any illegal or criminal acts, including but not limited to:
(1) Endanger the national security of the country or region where you live, leak state secrets, subvert state power, or destroy national unity;
(2) Engage in any illegal or criminal acts, including but not limited to money laundering and illegal fund-raising;
(3) Use any automated programs, software, engines, web crawlers, web page analysis tools, data mining tools or similar tools to access the Services of the Platform, collect or process the content provided by the Platform, or interfere with or attempt to interfere with any user;
(4) provide gambling information or induce others to gamble in any way;
(5) Hacking into other people's Crestvault COIN wallet to steal digital tokens;
(6) Conduct transactions that are inconsistent with the content of the transaction declared by the counterparty or are untrue;
(7) Engage in any acts that infringe or may infringe the Crestvault COIN service system and data;
(8) Other behaviors deemed inappropriate by the Platform for reasonable reasons.
4. You understand and agree that, as a result of your violation of the relevant laws (including but not limited to customs and/or tax regulations) or the provisions of this agreement, make this platform to suffer any loss, claim by any third party or any administrative departments of punishment, you deal with this platform to compensate, including reasonable attorneys' fees.
5. You promise to pay the service fees of the Platform on time (if any), otherwise the Platform has the right to suspend the services provided to you.
VII. Privacy Policy
Any data or information you provide to us is also governed by our Privacy Policy (the "Crestvault COIN Privacy Policy"), which is also part of this Agreement.
VIII. Other terms and conditions
1. Non-transferable. Subject to the terms of this Agreement, only you (and no one else) are entitled to claim against us in connection with your use of the Services. You may not assign, trade, or attempt to assign or trade your rights to this claim. Any such transfer shall be null and void and we shall have no obligation or liability to the transferee.
2. Intellectual property. Crestvault COIN is an application developed and intellectual property rights owned by the platform. The intellectual property rights of any content displayed in Crestvault COIN (including this Agreement, announcements, articles, videos, audio, pictures, archives, information, materials, trademarks or logos) are owned by the Platform or third party rights holders. Users may use the Crestvault COIN application and its contents only for the purpose of holding and managing digital tokens. No one may use, modify, reverse compile, copy, publicly disseminate, change, distribute, distribute or publicly publish the above application and content (including the Crestvault COIN open source code) without the prior written consent of the Platform or third party rights holders (or the permission of the relevant open source agreement). This Agreement shall not be deemed to grant you any intellectual property rights, including the right to use for any purpose any information, images, user interfaces, logos, trademarks, trade names, web domain names or Copyrights relating to us or the Services.
3. Non-waiver. Any failure by us to enforce this Agreement or to assert our rights, claims or causes of action against you under this Agreement shall not be construed as a waiver of our right to assert any rights, claims or causes of action against you.
4. Entire Agreement:
(1) This Agreement is made up of the Crestvault COIN Service Agreement, the Crestvault COIN Privacy Policy and the rules published by the Platform from time to time (including the "Help Center").
(2) With the exception of the Crestvault COIN Service Agreement and the Crestvault COIN Privacy Policy set forth herein, this Agreement contains all agreements and understandings between us regarding the use of Crestvault COIN and related Services and supersedes all prior agreements, understandings or arrangements (oral and written).
5. Tax:
(1) Use of the Services hereunder does not include taxes applicable, incurred or related to your use of the Services in any jurisdiction (" Taxes payable ").
(2) You are responsible for determining any tax payable and reporting, withholding, collecting, reporting and paying the correct tax payable to the appropriate tax authorities. You are solely responsible for all penalties, claims, fines, penalties and other liabilities arising out of failure to complete or perform any of your obligations in connection with the tax payable.
(3) We are not responsible for determining any tax payable, nor for reporting, withholding, collecting, reporting and paying the correct tax payable to the appropriate tax authorities.
6. Application of Law and Dispute Resolution:
(1) This Agreement shall be governed by and construed in accordance with the laws of the Republic of Singapore.
(2) In case of any dispute arising out of or in connection with this Agreement (including any question concerning its existence, validity or termination), the parties shall first seek reconciliation. If the dispute within 30 days after the start of a program in the settlement is still not solved, the dispute shall be submitted to Singapore international arbitration centre (" SIAC "), and by following the Singapore international arbitration centre then effective arbitration rules (the rule is considered by reference into this clause), and finally resolved by arbitration in Singapore. The arbitral Tribunal consists of one arbitrator appointed by the SIAC Chairman. The language of arbitration shall be English. Each party irrevocably accepts the non-exclusive jurisdiction of the courts of Singapore to support and assist arbitration proceedings pursuant to the foregoing in this paragraph, including interim relief (if necessary) pending the outcome of such proceedings.
7. Contracts (Rights of Third Parties) Act. The Contracts (Rights of Third Parties) Act (Cap 53B) of the Republic of Singapore, as may be amended, amended or supplemented from time to time, shall apply to this Agreement. No person who is not a party to this Agreement shall have any rights under this Agreement or have the right to enforce this Agreement.
8. Independence and partial invalidity:
(1) If any part of this Agreement is deemed invalid, illegal or unenforceable by any legislation binding this Agreement, it shall be deemed invalid, illegal or unenforceable only to that extent (and shall not be extended further). For the avoidance of doubt, the remainder of this Agreement shall remain in full force and effect.
(2) The holding of any provision of this Agreement as illegal, invalid or unenforceable under the laws of any jurisdiction shall not affect the holding of such provision as legal, valid or enforceable under the laws of any other jurisdiction, nor shall it affect the legality, validity or enforceability of any other provision of this Agreement.
9. Translation of this Agreement. Any translation of this Agreement, if any, is provided for the convenience of user only and is not intended to modify the English version of this Agreement. In the event of any conflict between the English version and a non-English version of this Agreement, the English version shall prevail.
IX.other
1. You shall fully understand and comply with all relevant laws, regulations and rules of your jurisdiction and use of the Services.
2. If you encounter any problems while using the service, you can contact us by submitting feedback community on Crestvault COIN and email.
3. All users can view this agreement in Crestvault COIN. The platform encourages you to review this Agreement every time you visit Crestvault COIN.
4. This Agreement shall come into force on March 27, 2021.
For matters not covered herein, you shall abide by the announcements and relevant rules updated by the Platform from time to time.
